1. Acceptance of Terms

By accessing or using the Gifts and Fests app, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, please do not use the application.

2. Eligibility

You must be at least 13 years of age to use this application. By using the app, you represent and warrant that you meet this requirement.

3. User Accounts and Registration

To access certain features, users must register using their mobile number and complete OTP verification. Google Sign-In is also supported. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

By using Gifts and Fests, you agree to:

• Provide accurate and complete information during registration and profile setup.
• Use the app only for lawful purposes and in compliance with all applicable laws and regulations.
• Not upload or share any content that is offensive, defamatory, infringing, or illegal.
• Respect the privacy of others when creating or sharing events.

5. Event and Media Content

You may upload event information, images, and audio notes. These remain your content, and we do not claim ownership. However, by submitting content, you grant us a limited license to use, store, and process it to provide the app’s core functionalities (e.g., displaying event details, setting reminders). Media files may be stored in your connected Google Drive account, and you are responsible for managing access and permissions.

6. Subscription and Payments

The app offers free and premium features. Premium services are available via in-app subscription through a third-party payment gateway. All payments are processed securely, and subscription details (including history and status) are accessible within the app. Subscriptions are non-refundable except where required by law.

7. Third-Party Integrations

Our app may integrate with third-party services such as:

• Google Drive for storing user-uploaded photos.
• Google Calendar for event reminders.
• Payment Gateway for handling transactions.

You are subject to the terms and privacy policies of these third-party services when using them.

8. Termination

We reserve the right to suspend or terminate your access to the app at any time without prior notice if:

• You breach any terms in this agreement.
• Your actions pose a risk to the app, its users, or legal compliance.

You may delete your account at any time. Upon deletion, your data will be removed from our systems as per our Privacy Policy.

9. Limitation of Liability

We strive to maintain an error-free, functional app, but we do not guarantee uninterrupted or bug-free operation. AEJOSE TECH PRIVATE LIMITED is not liable for:

• Any direct, indirect, or consequential loss resulting from the use or inability to use the app.
• Loss of event data, media files, or user content due to user error or third-party services.

10. Indemnification

You agree to indemnify and hold harmless AEJOSE TECH PRIVATE LIMITED from any claims, damages, or legal expenses arising out of your use of the app or violation of these terms.

11. Modifications to the Terms

We reserve the right to update these Terms and Conditions at any time. We will notify users within the app when significant changes are made. Continued use of the app after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Cuddalore District, Tamil Nadu.
